The ten leases were originally granted for 99 years from 29 September 1987. Eight of the ten leases (excluding No 3 and 5) have been extended by 90 years.

Freehold Title

The freehold of the site is owned by Penfold Gardens (Swindon) Management Company Limited under two titles. WT55310 covers the area occupied by the properties and their gardens and WT79345 which is an access strip to the rear of the site. The site is located in an old quarry and the access strip provides access to the quarry wall and quarry face.

1984 Deed of Release

The document is a 1984 Deed of Release in which John William Hesketh Goddard releases Duncan Graham Penfold and his land from a historic 1909 restrictive covenant, in return for a payment of £50 and only to the extent that Goddard is legally able to release it.
It outlines the origins of the covenant, the relevant land description, and confirms that the transaction is not part of a larger series exceeding £30,000.
The final pages include schedules detailing the land, the covenant terms, the title history, and a Land Registry plan (Title WT55310).

Land Transfer 28 February 1986

The site was transferred from Duncan Graham Penford to Marlborough Homes Ltd in 1986. The transfer includes "a perpetual right of way for the Transferee and all persons authorised by it with or without vehicles for all purposes connected with the use and enjoyment of the land".
